2. What SimplyRecommend provides
SimplyRecommend is an independent Recommendation Marketing platform. It may provide ready-made Marketing Materials, tracked links, QR codes, Pre-Sell Pages, campaign tools, educational content, statistics, recommendations and other affiliate-enablement features.
3. Independent status
Unless expressly stated otherwise, SimplyRecommend is independent from the third-party brands, merchants, affiliate networks and programs whose products or opportunities may be referenced. Product sales, official affiliate registration, commissions, eligibility, checkout, fulfilment and official program terms are controlled by the relevant third party.
4. Accounts and eligibility
- You must provide accurate information and keep account details reasonably current.
- You are responsible for maintaining the security of your login credentials and for activity under your account.
- Access to a specific Promotion may require an external affiliate account, approved destination, nickname/ID, vendor approval, sponsor/network position or another eligibility condition imposed by the underlying program.
- SimplyRecommend may suspend or restrict access where eligibility, security, compliance or misuse concerns arise.
5. Marketing Materials and compliance
SimplyRecommend may provide centrally approved Marketing Materials for use in supported Promotions. Users must follow all applicable laws, advertising-platform rules, disclosure requirements and underlying merchant/network rules. Users may not alter approved claims, remove required disclosures, misrepresent a product or relationship, or use materials in a prohibited context.
Availability of a Marketing Material does not mean it is suitable or lawful in every country, medium or campaign context. SimplyRecommend may limit materials by market, language, Promotion, status or other criteria.
6. No earnings or profitability guarantee
Affiliate marketing involves commercial risk. SimplyRecommend does not guarantee sales, customers, commissions, profitability, return on advertising spend or any particular result. Historical tests, examples or performance data reflect specific conditions and do not guarantee that another Affiliate will obtain the same outcome.
7. Third-party destinations and transactions
When you or a visitor leave SimplyRecommend for a third-party website, that third party controls its own product information, assessment, checkout, privacy, terms, fulfilment, refunds and other transaction matters. SimplyRecommend is not the seller or manufacturer of third-party products unless explicitly stated otherwise.
8. Intellectual property
SimplyRecommend and its original platform content, layouts, copy, systems and materials are protected by applicable intellectual-property laws. Subject to account eligibility and material-specific rules, Affiliates receive a limited, non-exclusive, revocable right to use approved Marketing Materials solely for permitted promotion of the relevant Promotion. Third-party brand assets remain the property of their respective owners.
9. Prohibited use
- Illegal, deceptive, fraudulent or misleading use.
- Unapproved medical, disease, treatment, performance, earnings or other restricted claims.
- Misuse of trademarks, logos, product imagery or third-party content.
- Attempting to bypass tracking, permissions, eligibility or security controls.
- Uploading or distributing malicious code, spam or other harmful content.
- Using SimplyRecommend in a way that violates the applicable affiliate program, merchant or advertising-platform rules.
10. Availability and changes
We may add, modify, pause, replace or retire features, Promotions, Marketing Materials or Pre-Sell Pages. Where practical, distributed SimplyRecommend routes may continue to resolve to an approved replacement rather than a broken page.
11. Disclaimers
SimplyRecommend is provided on an ‘as available’ basis to the extent permitted by law. We do not guarantee uninterrupted availability, error-free operation, continued availability of a third-party Promotion, or the accuracy of information controlled by a third party. Health-related content is subject to the separate Health & Medical Disclaimer.
12. Limitation of liability
To the maximum extent permitted by applicable law, SimplyRecommend and its operator are not liable for indirect, incidental, special or consequential losses arising from use of the service, third-party products or external affiliate programs. Nothing in these Terms excludes liability that cannot lawfully be excluded.
13. Governing law
These Terms are governed by the laws of Slovenia, subject to any mandatory protections that apply under the law of the user’s country of residence. Competent courts and dispute procedures are determined by applicable law.
